Terms of Use

These Terms of Use (“Terms”) govern your access to and use of DeepJournal, including our applications, websites, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Please also read our Privacy Policy, which explains how we process personal data.


1. Who We Are

DeepJournal is operated by:

Registered in France

These Terms form a legally binding agreement between you and Andicop.

The Service is provided only to individuals, not businesses or enterprises.


2. Eligibility

You must be at least 16 years old to use the Service.

By using DeepJournal, you represent and warrant that:

  • You are at least 16 years old
  • You have not been previously suspended or banned from the Service
  • Your use of the Service complies with applicable laws

We do not knowingly permit use by children under 16.


3. Account Registration and Security

To access most features, you must create an account.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Ensuring the information you provide is accurate and up to date

3.1 Login Credentials vs. Encryption Credentials

DeepJournal uses an encrypted local database and end-to-end encryption (E2EE) for configured sensitive fields during synchronization.

Important:

  • Your account login password is separate from your encryption password
  • Logging into your account does not grant access to your encrypted journal
  • Only your encryption password (or recovery key) can unlock your data

3.2 Lost Encryption Credentials

DeepJournal cannot recover:

  • Your encryption password
  • Your recovery key
  • Your encrypted data

If you lose both your encryption password and recovery key, your data is permanently inaccessible. You acknowledge and accept this risk.


4. Encryption and Content Access

Configured sensitive fields—including journal entry content and selected memory, thread, and chat fields—are encrypted locally before synchronization. Operational metadata and unconfigured fields are not covered by this field-encryption layer.

As a result:

  • The synchronization service stores ciphertext for configured sensitive fields
  • We do not receive the plaintext data-encryption key used to decrypt those fields
  • We cannot provide decrypted copies of those encrypted fields on your behalf
  • Record identifiers, dates, update timestamps, word counts, relationships, settings, processing status, selected models, and similar operational metadata may remain visible

The local database is encrypted while stored on disk. Data is available to the application while your journal is unlocked; no local encryption system can protect plaintext from an attacker who controls an already unlocked device.

You are solely responsible for the content you create and store using the Service.


5. User Content and Ownership

You retain full ownership of all content you create in DeepJournal.

By using the Service, you grant Andicop a limited, non-exclusive, revocable license to:

  • Store encrypted data
  • Sync encrypted data across your devices
  • Process data as technically necessary to provide the Service

This license ends when your account is deleted.

We do not claim ownership of your journal content.


6. AI Features

6.1 Nature of AI Outputs

DeepJournal may provide AI-powered features, including writing assistance and analysis.

You acknowledge that:

  • AI outputs are generated automatically
  • AI outputs may be inaccurate, incomplete, or misleading
  • AI outputs are not authoritative

You are responsible for evaluating and using AI outputs at your own discretion.

6.2 No Professional Advice

AI features do not provide:

  • Medical advice
  • Mental health or therapeutic advice
  • Legal advice
  • Financial advice

DeepJournal is not a healthcare, medical, or professional service.

6.3 Privacy-Preserving AI

DeepJournal's supported AI path encrypts request and response bodies between the desktop client and attested secure enclaves. Authentication, routing, rate-limit, timing, request-size, usage, and billing metadata may remain visible outside the encrypted body.

6.4 Optional Third-Party AI Providers

In the future, you may be given the option to enable third-party AI providers (such as OpenAI or Anthropic).

If you choose to enable them:

  • Your data may be processed under their own terms and privacy policies
  • End-to-end encryption guarantees may differ
  • Andicop does not control those providers

You will be informed before enabling such features.


7. Acceptable Use

You agree not to use the Service to:

  • Violate any law or regulation
  • Harass, abuse, or harm others
  • Circumvent security or encryption mechanisms
  • Reverse engineer, decompile, or exploit the Service
  • Scrape, harvest, or automate access to the Service
  • Interfere with the integrity or availability of the Service

We do not routinely monitor journal content. We may take action based on account behavior, visible operational metadata, reports, or other evidence of misuse of the Service.


8. Subscriptions and Payments

8.1 Paid Features

Some features require a paid subscription.

Prices are displayed in the Service and may change with advance notice.

8.2 Billing

  • Subscriptions are billed monthly
  • Payments are processed by Stripe
  • Subscriptions automatically renew unless canceled

8.3 Cancellation

You may cancel your subscription at any time before the renewal date through your account settings or by contacting us.

8.4 No Refunds

All payments are non-refundable, except where required by law.

This includes unused time or unused AI credits.

8.5 Consumer Withdrawal Rights (EU)

If you are a consumer in the European Union, you may have a statutory right of withdrawal for digital services under applicable consumer law. However, by subscribing and accessing paid features immediately, you expressly consent to the immediate performance of the Service and acknowledge that you may lose your right of withdrawal once performance begins, where permitted by law.


9. Termination

9.1 By You

You may stop using the Service and request account deletion at any time.

9.2 By Us

We may suspend or terminate your access if:

  • You violate these Terms
  • Your use poses security or legal risks
  • We are required to do so by law

We may act without prior notice in urgent situations.

9.3 Effect of Termination

  • Server-side data will be deleted according to our Privacy Policy
  • Local encrypted data remains on your device until you delete the app
  • We are not responsible for retaining local data

10. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Accuracy of AI outputs
  • Preservation of data if encryption credentials are lost

11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for:
    • Lost encryption keys
    • Lost or inaccessible data
    • AI errors or outputs
    • Third-party services or providers

Our total liability for any claim is limited to the greater of:

  • The amount you paid us in the 6 months before the claim, or
  • €100 / $100

12. Indemnification

You agree to indemnify and hold harmless Andicop from any claims, damages, or expenses arising from:

  • Your misuse of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights

13. Governing Law and Jurisdiction

These Terms are governed by the laws of France, without regard to conflict-of-law rules.

If you are a consumer in the EU, mandatory consumer protections apply.

Any disputes shall be brought before the competent courts of France, unless mandatory law provides otherwise.


14. Changes to These Terms

We may update these Terms from time to time.

If we do:

  • We will update the “Last updated” date
  • Continued use of the Service constitutes acceptance

If you do not agree to updated Terms, you must stop using the Service.


15. Electronic Communications and Marketing Preferences

By using the Service, you agree to receive electronic communications related to:

  • Your account
  • Security notifications
  • Billing and subscription information
  • Legal notices
  • Changes to the Service

These communications are necessary for the operation of the Service.

15.1 Marketing and Product Updates

We may also send you product updates, feature announcements, or journaling-related communications only if you have explicitly opted in to receive such emails.

You may withdraw your consent at any time by:

  • Clicking the unsubscribe link included in marketing emails
  • Updating your account preferences
  • Contacting us directly

Withdrawing consent does not affect essential service communications.


16. Export and Trade Controls

You agree to comply with applicable export control and sanctions laws.

You may not use the Service if prohibited by applicable trade restrictions.
